Terms of Service

1. Acceptance of Terms

By creating an account or using Sevia ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service.

2. Eligibility

You must be at least 18 years of age and a resident of the United States to use Sevia. By registering, you represent and warrant that you meet these eligibility requirements.

3. Account Obligations

When creating and maintaining your account, you agree to:

  • Provide accurate, current, and complete information during registration and keep it updated.
  • Maintain the confidentiality of your password and restrict access to your account.
  • Accept responsibility for all activity that occurs under your account.
  • Notify us immediately of any unauthorized use of your account.

4. Financial Disclaimer

Sevia is an envelope budgeting tool designed to help you organize and track your finances. Sevia is not a financial institution, bank, credit union, or investment advisor. The Service does not provide financial, investment, tax, or legal advice.

Any budgeting categories, suggestions, or organizational features within the Service are for informational and organizational purposes only. You are solely responsible for your financial decisions.

5. Third-Party Services

Sevia uses Plaid to provide bank account connectivity. By linking a financial account through the Service, you acknowledge and agree to Plaid's terms and conditions.

We are not responsible for the availability, accuracy, or security practices of any third-party service. Your use of third-party services is at your own risk and subject to their respective terms.

6. Data Handling

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you grant Apex Support LLC a limited, non-exclusive license to process, store, and display your financial data solely for the purpose of providing and improving the Service's functionality. We do not sell your data.

7. Acceptable Use

You agree not to:

  • Attempt to gain unauthorized access to the Service, other accounts, or any systems or networks connected to the Service.
  • Scrape, crawl, or use automated means to access or collect data from the Service without prior written consent.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
  • Use the Service for any illegal, fraudulent, or unauthorized purpose.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Transmit any malware, viruses, or harmful code through the Service.

8. Intellectual Property

The Service, including its design, code, features, branding, and documentation, is owned by Apex Support LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without prior written consent.

You retain full ownership of your personal and financial data. We claim no intellectual property rights over the content you provide to the Service.

9. Account Termination

Termination by You

You may delete your account at any time through the Data & Privacy section in your account settings. Upon deletion, your data will be permanently removed in accordance with our Privacy Policy.

Termination by Us

We reserve the right to suspend or terminate your account if you violate these Terms. Where practicable, we will provide reasonable notice and an opportunity to remedy the violation before termination. In cases of severe or repeated violations, we may terminate access immediately.

10. Limitation of Liability

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Apex Support LLC is not liable for any financial decisions you make using the Service. To the maximum extent permitted by law, our total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees you have paid to us (if any) in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Apex Support LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your misuse of the Service, violation of these Terms, or infringement of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

13. Dispute Resolution

In the event of any dispute arising from these Terms or your use of the Service, the parties agree to first attempt to resolve the matter through good faith negotiation. If the dispute cannot be resolved within thirty (30) days of written notice, either party may pursue resolution through the state or federal courts located in Florida.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

15. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least thirty (30) days' notice via email or through the Service before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
